Terms of Service

Pulse is operated by Brew and Food, LLC ("Brew and Food," "we," "us"). These Terms are an agreement between you and Brew and Food, LLC.

These Terms govern your use of Pulse (brewandfood.com and its related apps). By creating an account or using Pulse, you agree to them. If you don't agree, please don't use the app. See also our Privacy Policy, which explains how we handle your data.

What Pulse is

Pulse is a community-verified discovery app for happy hours and deals. Deal information, hours, and prices are submitted and confirmed by Scouts (users) and venue owners, not independently verified by Pulse staff. Always confirm details with the venue before you go — Pulse doesn't guarantee any deal's accuracy or availability.

Accounts

• You sign in via our authentication provider (Clerk) using Google or email
• You must provide accurate information and keep your account secure
• One account per person; accounts aren't transferable
• You're responsible for activity that happens under your account

Age

You must be at least 21 years old to create or use a Pulse account. By signing up you certify that you are 21 or older and that the date of birth you provide is accurate. Pulse does not verify your age; venues will check identification and may refuse service.

Your content

You keep ownership of the photos, notes, live-chat messages, and other content you submit. By posting it, you give Pulse a license to display, distribute, and use it within the app (including aggregated or de-identified for analytics) for as long as your content remains posted.

You agree not to:

• Post content that's false, harassing, hateful, or unlawful
• Fake a check-in or GPS location, or otherwise manipulate the trust/consensus system
• Create multiple accounts to inflate your influence ("Sybil" behavior)
• Attempt to post in a venue's live chat, or use any other feature that requires being on-site, without actually being there
• Scrape, resell, or use Pulse's data outside the app without permission
• Impersonate a venue you don't own or operate

We may remove content, adjust trust scores, or suspend accounts that violate these rules. Use the report action on a photo, venue reply, or chat message to flag content for review. Live venue-chat messages are also removed automatically a short time after a happy hour ends — see our Privacy Policy for details.

Venue owners

• Claiming a venue means representing that you own or are authorized to manage it
• Claiming and the full owner dashboard are free — no payment is required for the core functionality
• Pulse Pro is an optional paid subscription, billed by Stripe. You can cancel any time from your dashboard; billing follows Stripe's standard terms
• We may remove a claim we determine was made without authorization

Venue offers

Some venues publish their own special offers on Pulse, such as a discounted appetizer or drink, which you redeem at the venue when staff scan your Pulse code. Venue offers are created, funded, priced and honored solely by the venue. Brew and Food, LLC does not sell, serve or provide any food or drink, is not a party to any transaction between you and a venue, and does not guarantee that an offer will be honored.

Each offer is one per person, has no cash value, can be shared only as a link for someone else to sign up and claim their own, is valid only at the times shown, and is void where prohibited. Venues may refuse service for any lawful reason, including when you can't show valid ID or appear intoxicated.

Offers that include alcohol are only for people 21 or older, end by 11 PM, and apply only where and when the venue may lawfully serve. Please drink responsibly and never drink and drive. Brew and Food, LLC is not responsible for the service or consumption of alcohol at any venue or its consequences. Venues that publish offers accept the Venue Owner Agreement.

No warranty

Pulse is provided "as is." We don't warrant that the app will be uninterrupted, error-free, or that any deal, price, or hours of operation shown is accurate — that information comes from the community and venues, not from Pulse directly.

Limitation of liability

To the fullest extent permitted by law, Pulse isn't liable for indirect, incidental, or consequential damages arising from your use of the app, including reliance on deal information that turns out to be inaccurate or expired, or for any act or omission of a venue, including failing to honor an offer, the legality of an offer, or the sale, service or consumption of food or alcohol.

Termination

You can stop using Pulse and delete your account at any time. We may suspend or terminate accounts that violate these Terms.

Changes

We may update these Terms as Pulse grows. We'll update the effective date above; if a change is material, we'll make a reasonable effort to let you know in-app.

Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles.
