Venue Owner Agreement
Venue Owner Agreement (VOA-2026-10-18)
This agreement is between Brew and Food, LLC ("Pulse") and the business named when it is accepted ("the Venue"). It applies to every special offer the Venue publishes on Pulse ("Venue Offers"), and is in addition to the Pulse Terms of Service.
1. Your offers, your responsibility. The Venue is solely responsible for its Venue Offers, including their terms, pricing and availability; honoring them; and complying with all applicable laws, regulations, permits and licences, including the Texas Alcoholic Beverage Code, the rules of the Texas Alcoholic Beverage Commission (TABC), local ordinances, and consumer-protection, advertising, tax and food-safety laws.
2. Alcohol service. The Venue checks identification, serves alcohol only to people 21 or older, refuses service where the law requires (including to anyone who appears intoxicated), and serves responsibly. Alcohol offers end by 11:00 PM venue time and are for consumption on the Venue's licensed premises only.
3. Your representations. For each Venue Offer, the Venue represents that it is lawful where it will be redeemed; that the Venue holds every permit and licence it requires; and that it is funded solely by the Venue and not by any manufacturer, distributor, brand or other supplier.
4. Screening by Pulse. Pulse may screen, refuse, edit the display of, pause or remove any Venue Offer at any time, for any reason, without liability. Such screening is not legal advice, regulatory approval or a guarantee of compliance, and does not relieve the Venue of its obligations.
5. Indemnity. The Venue agrees to defend, indemnify and hold harmless Brew and Food, LLC and its members, officers, employees and contractors from and against all claims, liabilities, damages, losses, fines, penalties, costs and expenses (including reasonable attorneys' fees) arising out of or related to the Venue's offers; its sale or service of food or alcoholic beverages; any injury, death or property damage connected to its premises or service; its violation of any law, regulation, permit or the Pulse Terms; or any dispute between the Venue and a customer.
6. Redemption through a Pulse scan. Offers advertised through Pulse are redeemed through a staff scan of the guest's Pulse code. Pulse may audit redemptions (including asking guests and sending Pulse Team members). Redemptions of Pulse offers that were honoured without a scan count as billable visits once evidenced and after Pulse's stepwise escalation (a reminder, then offers paused, then a membership review).
7. Records. The Venue keeps the records the law requires for its promotions. Pulse's reports are provided for convenience and are not a substitute for the Venue's own records.
8. Changes and ending. Pulse may update this agreement; a new version must be accepted before further alcohol offers are published. Either party may stop Venue Offers at any time. Sections 1, 3, 5, 6 and 7 survive.
By accepting, the person accepting confirms they are authorized to bind the Venue.Confirmed for each drink offer
